To enforce an Arbitration award of $1.2 Billion, Cairn Energy has sued India’s flagship carrier Air India. This move builds an extensive pressure on the Government of India to pay such a huge amount along with interests and attached costs. The body essentially ruled that India breached an investment treaty with Britain and said New Delhi was liable to pay.
In the US District Court for the Southern District of New York, Cairn filed the law suit seeking to make Air India liable for the judgement that was awarded to Cairn. The lawsuit argued that the carrier should be observed as a state-owned company and is legally indistinct from the state itself.
